Phillios got stopped in the above area and asked me to put something up for anyone watching

He's 2 hours over the limit so just a heads up boys

Got pulled by VOSA this morning at Milłbank and was 2 hours over my weèkly rest which was 45 hours and I only had 43 hours on my tacho card ,
They finned my £200 plus gave me a 45 hour prohibition which means I can't drive a hgv for 45 hours ,
I then had to get my mechanic to come and drive my lorry back to his garage or they where going to impound it .
When I was leaving a half decent copper came up to me and said warn your mates the VOSA are clamping down big time on drivers rest hours ,
So make sure you know you have your 45 hours one weekend and 24 hours the next ,
It means if your working weekends you can't drive on a Monday until your weekly rest period is over ,
Also had to show them my scaffolders card as I don't have the CPC or they would have done me for that as well

Ffs phil sorry to hear that m8 but tbh sounds like u got away quite lightly @ least that clarifies there stance over the cpc - I'd better make sure my boys av there ticket on them

You gotta SP they told me I would have been done for that as well if I couldn't produce my scaffolders ticket , also I had no walk around inspection book , which I got a warning for and if caught again would be done for , so make sure the lads have the inspection book as well ,
2 hours I was out in 2 weeks SP and they done me to the letter mate no mercy or understanding whatsoever , and all that really done me was I got caught up in the Wimbledone tennis traffic which meant I was very late getting back to the yard a couple of Saturday's ago ,
The police man who was actually not a Bad fella told me he has to work with VOSA and they told him to pull every scaffold lorry that comes along even if it meant letting other trades go past ,
It's the weekends that will **** you as you have to have the weekly rest of 45 and 24 hours alternate weeks or start late on a Monday

Don't see the starting late getting too many complaints from the men Phil. ;) You're right about VOSA though, they've got a hard on for scaffolding wagons. Easy pickings for the b@stards.

how does that work out when your only driving 2 3 hours aday thats only 21 hours a week, could you not just keep yesterdays tacho some were then place it back in after a day then repeate ? and can you still get away with hours logged as aposed to tachos

Starting 2 days late will pete

Nope bad day at the office all round but Phil has a great bunch of lads that will muck in and do him proud to make up the time lost

Upwards and onwards.

What if you haven't got a licence and produce your advance card?

It's a bit more complex then that Marra ,
You can only drive a max of 90 hours in 2 weeks ,
I would only drive about 36-40 hours in 2 weeks but you can't accrue the hours,
And you have to have 45-24 hours weèkly rest on alternative weeks which I didn't ,
I went 2 hours over on one week ,
Basically I should have left the yard at 8.15 instead of 6.15 on the Monday
And Iam in the wrong in their eyes ,
They won't accept the fact the we don't drive all day for a living only 3-4 hours a day .
So now I get flagged and stopped at every VOSA check point because I was 2 hours late getting back to the yard

Its prob a digitacho card marra - ffs I 4got about those little books

Me to SP I got 4 on eBay for £13 tonight not worth not having them fella
Basically if we don't conform they will give us no quarter because we are scaffolders ,
We need to make sure whoever is driving is above the law is the way it was put to me

It was a digitacho SP and they just down load the last 28 days on a laptop and can tell exactly what the lorry and any driver has done

Doe a favour phil & put the ebay link on m8 - better order a few myself

Sorry to hear the SS vosa officer's got you Phillo

Were you driving for that duration or were you on other duties?

only I thought if you were scaffolding, there was no limit?
Transports Friend - GB domestic rules

Maybe worth looking into, as these feckers will now be lookin at your score for the OL and may turn up at your yard shortly

Yeh me to hatter as prob only drive total of 12hrs a wk but spose the tacho card will show that as 5 days

56 hours a week driving time with your daily rest is what you can have ,
But over 2 weeks it's a total of 90 hours ,
I would drive no more then 3 hours a day so over 5 days it's only 15 hours
But it's only the maximum they are concerned with ,
And the weekly rest which is 45 hours minimum one week and 24 hours minimum the next week ,
It should only relate to drivers who drive all day every day but HGV scaffold lorrys comes into E.U diving rules and we are gonna be drawn into line with it was the way it was put to me yesterday ,
So know your hours and watch your weekly rest periods lads ,
Basically you can only drive every other weekend or your stuffed

Do you know what phil - ive been thinking abour this all day & cant quite get my head around it.
on 1 hand by them excepting your scaff tckt as proof of excemption from the cpc they are technically agreeing that you are not a full time driver, but on the other hand even though the digitacho card must have shown actual driving time as well as time it was in the machine, they decided to act on that time. If it had been an analog & switched to work mode than it wouldnt have counted as driving - personally its a bitnof an enigma & I think you should should be able to appeal.....at the very least try & contact the rha for some type of clarity
