You pay your money and take your chance...
HSE are always going to going after the ones who can pay - normally MC's for letting it happen and not managing it. Then they'll go after the bigger subbies. Point is, if the changes / omissions you make result in an incident, then HSE 'could' although I've not heard of it yet - prosecute you / your firm as a Designer under CDM. At this point yes you would need PI. Your contractors all risk will probably read all risk (excluding design) in the fine print.
If you think Designers earn a lot - just wait until the lawyers get involved!
