I need to take some legal advice regards a site we have on the go ,

Does anyone have contact details for someone they have used in the past that could help me with contract agreements ,

The site we have going is not agreeing any valuations and taking money of us that has already been agreed and paid in the past as the surveyour has left and the director does not think they where agreed properly and has stopped almost £20k on the last invoice , I took all the lads of site until it is sorted but know he is looking to get someone else on site and charge us all associated cost regards down time for other trades and cost associated with getting another firm in.

We have at least another 2 months left on site so I can't just strike the scaffold overnight and put it down to experience any help or advice would be appreciated ;)

'Local Democracy, Economic Development and Construction Act 2009'.

For a contractor to legally deduct monies from your valuation/invoice he needs to issue a 'Pay less notice' 5 days before the payment due date of that invoice. he needs to show adequate reason's for doing so. if he is deducting monies without good reason then he could be in breach of contract. If he is in breach you would need to issue in writing a 7 day letter informing him of withdrawal of labour.

We all know this is his ploy to build a negotiating buffer to rape your final account and you need to deal with it robustly now.

I think Hatterscaff had a similar problem recently.
 
Yep I still am having issues, but the job I was on, only went bad once we struck:mad:
with them not issuing you with a withholding notice, they are in breach

tbh if they are feckin you around with the scaff still up, you probably are in for a bigger fight to get much more money out of them and you will have to weigh up the gamble

I contacted scaffold mediations (you will need to phone him) he's on the forum and we are looking at the court side of things now, but feck it we wont be working for these ciints again anyway

I fear that many main contractors are reaping the fruits of their badly priced jobs and more and more will be looking to go subbie bashing in the very near future

sorry to hear of your predicament Phillio and Hatter.Its these sorts of storys that fill many with dread of "GOING OUT ON THEIR OWN".

hello phil sorry to hear of your predicament ,jus a quick one if you have a signed contract with agreed rates for your terms an conditions he is automatically in breech of contract.
And as for moving the goalpost because he thinks he can swindle you over and deduct monies from agreed contracts comes under unlawful deductions,
As for trying to back charge you for lost man hrs he will have to foot the bill lost man hrs s caused by is own doing an no one elses.
your case is only as strong as your paperwork phil act quick tell him to prepare his case and do not move any materials off site,
if you move any scaffolds off site he can counter su on breech of contract move quickly have your solicitor send him a letter.
If this man thinks he can just deduct money off you for woks carried this is unlawful theft,
make him aware you will not be moving no scaffolds and you will persue all lost earnings in court all the best scc.
