Does anyone know that if work is slack whilst waiting for jobs to start in July / August what the rules regarding your boss saying sorry no work today. What are our rights, we are PAYE and paid monthly, not sure if paid monthly makes any difference. We do not have up to date contracts but the last one said you could be laid off without pay how long can your boss do this for?
 
Bit of a grey area tbh- If ur on a zero hour contract m8 ...sorry but u got no hope...it really does depend on ur contract.contracts are sometimes timescaled but if not then u must assume its an open ended employment - so just because its not recent diesnt mean its not binding.
the only advise I would give u is dont moan too much or burn your bridges but look around sharpish & take the 1st start you get...bit of a shortage of qualified scaffs at the mo...so if your boss wants ya back he'll av to pay ya not to go

personally i wouldnt be with any company that doesnt give me a contract with at least 35 hours a week Check your contract and if it states a certain amount of hours then hes to honour it but its probably better to move on;)
 
as sp says look for other work and if the guy wants you back when work picks up tell him you want a proper contract with a guaranteed 38 hrs,holiday pay and sick pay
 
How long have you been with your employer, if he is laying you off and you have been there a few year you could be entitled to redundancy money. Also if you are paid on a monthly basis I believe you are entitled to 4 weeks notice period.

Trouble is DS theres a difference between being laid of or stood down/put on short time.
if its a small company the reason to stand down is theres not enough cash flow to continue payin u ...so all the shouting & threats wouldnt do any good if theres no work theres no work.poss just a temp blip
if its a medium/ larger company then its sometimes a different story you should only be expected to lose days if everyone loses em.
trouble is in this game youve either got too much work & running around like a headless chicken or u got nothing & struggle...just no happy medium lol
 
If there's no work then there's no work, don't add to their problems change overalls or just move on.
You can always go back if they're not sucked dry.
 
I understand what you are saying southern and swifty from an employers view. But from an employees view he may qualify for redundancy IF he is being laid off and has been employed there more than 2 years. If the company cannot afford to pay redundancy then the government would pick up the tab although this would put the company into administration. Anyway there's a link below for the lad to calculate any redundancy owed if in fact he is being laid off and not put on short hours.

By law the employer can lay you off for 13 weeks. But after 4 weeks YOU can write a letter asking for redundancy. If they say no they have to employ you solidly for 13 weeks before they can lay you off again
