REFERENCE: ECI/0211 The UK Ministry of Defence, intends to award a contract to HARSCO Infrastructure Services Ltd to extend existing Enabling Arrangements with a new Contract for the provision of temporary skeletal steel structures which comprise various scaffolding, ancillary component products and structures, including a hire and design service to the approved specification standards as those previously supplied. The Contract will allow call-off the listed products and services for a period of 3 years with options to extend for further years. It is considered that this contract can be placed using the negotiated procedure without prior publication pursuant to Article 31(2)(b) of Directive 2004/18/EC (Regulation 14(1)(b)(ii) of the Public Contracts Regulations 2006). This is because Harsco are the original equipment manufacturer and a change of supplier will introduce material and different technical characteristics which will result in incompatibility/interoperability difficulties in operating and maintaining the structures together with a disproportionate impact in alternative training and logistics. Retaining the proposed supplier will ensure contunity in the use of a standard UK MOD In-Service approved construction method (in terms of PASMA trained personnel to comply with Working at Height and Health & Safety Regulations) for a range of products which are required at short notice for use in an operational environments.
